1. Acceptance of Terms

By accessing or using WayOfThe.Art ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Service.

2. Service Description

WayOfThe.Art provides a school management platform for martial arts schools, instructors, students, and parents. Our Service includes both free and premium features.

2.1 Free Plan

The free plan includes core school management features with limitations. We reserve the right to modify free plan features and limitations at any time with notice.

2.2 Premium Plans

Premium subscription plans provide additional features and capabilities. Current pricing and features are available at /pricing.

3. Account Registration

• You must provide accurate, current, and complete information during registration
• You must be at least 18 years old or have parental consent
• School administrators are responsible for their school's account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account

4. User Responsibilities

4.1 School Administrators

• Ensure accurate student and instructor information
• Comply with local data protection regulations
• Obtain necessary parental consent for minors
• Maintain appropriate use of the platform by school members

4.2 All Users

• Use the Service only for lawful purposes
• Not attempt to gain unauthorized access to any part of the Service
• Not upload malicious code or content
• Not harass, abuse, or harm other users
• Respect intellectual property rights

5. Payment Terms

5.1 Subscription Billing

• Premium subscriptions are billed on a recurring basis (monthly or annually)
• Payments are processed through Stripe (international) or Curlec (Malaysia)
• All fees are in the currency specified at purchase
• Prices are subject to change with 30 days notice

5.2 Payment Methods

Malaysia: Payments processed via Curlec, supporting local payment methods including FPX and local cards.

International: Payments processed via Stripe, supporting major credit/debit cards worldwide.

5.3 Refund Policy

• Monthly subscriptions: Pro-rated refunds within 7 days of charge
• Annual subscriptions: Pro-rated refunds within 14 days of initial purchase
• No refunds for partial months or after the refund period
• Refund requests must be submitted via email to support@wayofthe.art

5.4 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You retain access to premium features until the end of the paid period
• No refunds for the remaining portion of the current billing period (except as stated above)

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

• We collect and process data as described in our Privacy Policy
• School administrators are data controllers for their students' data
• We comply with applicable data protection regulations (GDPR, PDPA, etc.)
• You retain ownership of your content and data

7. Data Ownership and Export

• You retain all rights to your data (student records, attendance, grades, etc.)
• You can export your data at any time in standard formats
• Upon account termination, we retain your data for 30 days before permanent deletion
• You can request immediate data deletion by contacting support

8. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted access
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our control

9. Intellectual Property

9.1 Our IP

The Service, including all software, design, text, graphics, and logos, is owned by WayOfThe.Art and protected by copyright and other intellectual property laws.

9.2 User Content

• You retain ownership of content you upload (photos, documents, etc.)
• You grant us a license to use your content solely to provide the Service
• You represent that you have rights to all content you upload

10. Prohibited Activities

You may not:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) without permission
• Resell or redistribute the Service
• Use the Service to transmit spam or malicious content
• Impersonate another person or entity
• Violate any applicable laws or regulations

11. Account Termination

11.1 By You

You may terminate your account at any time through account settings or by contacting support.

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• Your payment fails and is not resolved
• Your account is inactive for more than 12 months (free accounts)
• We must comply with legal requirements

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not responsible for third-party services or content

13. Indemnification

You agree to indemnify and hold harmless WayOfThe.Art from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any rights of another party
• Your use of the Service

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.

14.2 Arbitration

Any disputes will be resolved through binding arbitration in Malaysia, except:

• Claims for injunctive relief
• Claims related to intellectual property
• Small claims court matters

15. Changes to Terms

• We may modify these Terms at any time
• We will notify you of material changes via email or in-app notification
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

16. Geographic Restrictions

The Service is not available in all countries. We reserve the right to restrict access based on geographic location or local regulations.

17. Children's Privacy

• The Service is not intended for children under 13
• Schools must obtain parental consent for student accounts
• Parents have the right to access, modify, or delete their child's data

18. Third-Party Services

The Service integrates with third-party services (Google OAuth, payment processors). Your use of these services is governed by their respective terms of service.
